On March 6, 1970, the plaintiffs in error, Jose E. Lopez and Luis R. Molina, were found guilty of possession of heroin, contrary to sec. 161.02(1), Stats., and each sentenced to an indeterminate term of not more than two years in the state prison. On December 8, 1970, post-conviction motions were denied by the trial court. On March 6, 1970, on a charge of possession of heroin arising from the same set of facts, the wife of defendant Lopez, Maria Lopez, was found guilty and also sentenced to an indeterminate term of not more than two years in the state prison for women, with sentence stayed and defendant placed on probation. She is not appealing.
